Shall be 18 years old or more. A father or mother has the right to sign on behalf of their son or daughter regardless of their age. Shall be of sound mind and body. Shall be able to understand the contents of the declaration and sign it. Can read and write properly, otherwise may be assisted by another person who explains the contents and sign the declaration with him/her as witness. Both males & females are considered equal in consenting.
Father, mother, brother, sister, uncle, grandfather, grandmother, relatives, or any parent-in-law. The husband superseded the father & those who follow under him.
If the patient has no relatives residing in UAE: his /her sponsor or a substitute of the sponsor, then a friend may sign on his /her behalf.
An unconscious /incompetent emergency patient who has no guardian or substitute consent giver at the time he/she is admitted to the accident and emergency unit shall be exempted from giving consent. The husband must sign in person the declaration related to treatments and surgical interventions that may affect his wife’s fertility in the future.

Members of the medical team should answer patient’s /guardian’s/substitute consent giver’s questions in simple, easy to understand, & objective manner, without exaggerations or promises. There should be a common language between the patient, guardian or substitute consent givers and physician in order to understand the consent of the declaration. A translator may be used, if necessary, who must also sign the declaration.
يجب أن يكون عمره 18 عاما أو ما يزيد ، يحق لألب أو األم التوقيع بالنيابة عن ابنهم أو ابنتهم بغض النظر عن عمرهم. يجب أن يتمتع ذلك الشخص بالعقل السليم والجسم السليم. يجب أن يكون قادرا على فهم محتويات البيان والتوقيع عليه ويجيد القراءة والكتابة وإال فسوف يحتاج إلى مساعدة أي شخص آخر يشرح له المحتويات ويوقع على البيان معه كشاهد عليه. يتساوى الرجال والنساء بشأن الموافقة.
األب، األم، األخ، األخت، العم، الخال، الجد، الجدة، األقارب اآلخرين من طرف األب ثم األقارب اآلخرين من طرف األم. إذا كانت المريضة زوجة، سوف يتم تقديم زوجها في األولوية على والدها وأولئك الذين يتبعون تحته.
إذا لم يكن للمريض أي أقارب باإلمارات العربية المتحدة : يجوز لكفيله أو أي بديل عن هذا الكفيل أو صديقه بعد ذلك التوقيع نيابة عنه .
يتم إعفاء المريض الغير الواعي/ غير المؤهل الذي يتم إدخاله إلى وحدة الحوادث أو الطوارئ وال يكون لديه أي وصي أو مانح موافقة بديل من الموافقة المذكورة. يجب أن يوقع الزوج بشخصه على البيان ذا الصلة بالمعالجات والتدخالت الجراحية التي قد تؤثر على خصوبة زوجته في المستقبل.
بشأن أي نزاع قد ينشأ بشأن المعالجة أو التعامل مع المريض. تعتبر محاكم اإلمارات العربية المتحدة ذات اختصاص حصري إلصدار القرار والحكم بشأن هذا النزاع.
يجب أن يجيب أعضاء الفريق الطبي على أسئلة المريض/ الوصي/ مانح الموافقة البديل بطريقة بسيطة وميسرة للفهم والطريقة الموضوعية دون مبالغات أو وعود . ويعد الغرض من ذلك هو تقديم المعلومات الكافية بشأن جميع نواحي المرض والتدابير التشخيصية والمعالجات وأية تأثيرات جانبية أومضاعفات معتادة. يجب أن يكون ذلك واضحا وعلى أساس علمي ويسهل استيعابه وكافيا للمساعدة على اتخاذ القرار. يجب أن ال تحتوي هذه المعلومات على أية وعود أو توقعات.
يجب أن تكون هناك لغة عامة بين المريض أو الوصي أو مانح الموافقة البديل والطبيب من أجل فهم محتوى البيان. وقد تتم االستعانة بأحد المترجمين عند الضرورة وحال كون ذلك ممكنا ويكون على هذا المترجم التوقيع على البيان.
